Now, could this be one of the lawsuits that ends up before a U.S. District Court and makes the company have to turn over millions of dollars worth of damages? According to the press release, the incident happened when a factory trained employee was testing an “extraordinarily new hand restraint device” meant to hold golf clubs. The device had been approved by the Department of Transportation, but according to the Golf Cart Accessories Manufacturer, it was not fitted correctly and never meant to be used to hold golf clubs. When it became apparent that the Golf Cart accessories did not fit and that the employees had no idea how to adjust the device so that it held the club properly, they tested it again. This time, according to the news release, the factory employee tested it while it was actually in use. And the third time, things did not go well.

It’s hard to say what caused this accident, but it sure is startling, especially in New York, which is often considered one of the most litigious states in the country. Does the incident signal a need for more regulations to protect against product liability lawsuits, such as those that can stem from faulty airbags or seat belts? Could this case result in other lawsuits being filed against the company, for negligence in their design? If so, it could indeed be very helpful to consumers like you and me who are concerned about the safety of products that we use every day.

Why wouldn’t the company make a lighter and more compact ball suited for the man who wants to take the load off his shoulder? A lighter golf ball could easily prevent serious injuries on the course.

The question of whether or not it is legal has become more pressing after a string of news stories have suggested that thousands of people could have been hurt if the product had been used incorrectly. After all, manufacturers have been manufacturing the ball longer than any other brand. While this might indicate that manufacturers have more safety knowledge than most consumers, it also means that there is no way to know whether or not a product is inherently safer than another. Until Tiger Woods says definitively that it’s not allowed, the only way to know is to avoid it.
